Terms of Service

1. Acceptance of These Terms

These Terms of Service (“Terms”) are an agreement between you and Podvance (“Podvance”, “we”, “us”) governing your use of the Podvance mobile application and the podvance.com website (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Podvance helps you learn English by listening to podcasts. The Service provides podcast discovery and playback together with learning features such as transcripts, translations, vocabulary tools, AI-generated summaries, and shadowing practice. Features may differ by platform and subscription plan, and we may add, change, or remove features as the Service evolves.

3. Eligibility and Accounts

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the consent of a parent or guardian.

When you create an account you agree to provide accurate information and keep it up to date. You are responsible for keeping your credentials secure and for all activity under your account. Notify us at support@podvance.com if you suspect unauthorized use. You may register directly with an email address and password, or through Google or Apple sign-in.

4. Subscriptions and Payment

Some features require a paid subscription.

  • Billing. Subscriptions are purchased as in-app purchases through the Apple App Store or Google Play and are billed by Apple or Google under their terms, not by Podvance directly.
  • Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
  • Managing and canceling. You manage and cancel your subscription in your App Store or Google Play account settings. Deleting the app or your Podvance account does not by itself cancel a subscription.
  • Refunds. Refunds are handled by Apple or Google under their respective store policies.
  • Changes. We may change subscription prices or what a plan includes. For existing subscribers, price changes take effect at the next renewal and are communicated in accordance with the platform’s rules.

5. Podcast Content

Podcasts available in the Service are created and published by third-party creators and publishers, and are sourced from publicly available podcast feeds and directories. Podvance does not own podcast content and does not endorse its views.

  • Podcast content remains the property of its rights holders.
  • Availability of any podcast or episode is controlled by its publisher and may change or end at any time.
  • Audio may stream from, or be downloaded from, the publisher’s own hosting infrastructure.

If you are a rights holder and believe content is presented in the Service in a way that infringes your rights, contact us at support@podvance.com and we will review and respond promptly, including removing content where appropriate.

6. AI-Generated Content

Transcripts, translations, and summaries in the Service are generated automatically by machine learning systems. They are provided as learning aids only and may contain errors, omissions, or mistranslations. They are not a substitute for the original audio, and you should not rely on them where accuracy matters. The presence of AI-generated material alongside an episode does not imply any affiliation with or endorsement by the podcast’s creators.

7. Acceptable Use

You agree not to:

  • use the Service in violation of applicable law;
  • share your account or access another person’s account without permission;
  • copy, scrape, bulk-download, redistribute, resell, or publicly re-publish content from the Service, including transcripts, translations, and summaries;
  • circumvent, disable, or interfere with subscription entitlements, security features, or technical limitations of the Service;
  • reverse engineer, decompile, or disassemble any part of the Service, except to the extent such a restriction is prohibited by law;
  • use automated means to access the Service other than interfaces we provide; or
  • interfere with the operation of the Service or the use of the Service by others.

We may investigate violations and may suspend or terminate accounts involved in them.

8. Intellectual Property

The Service — including the Podvance name, logo, apps, website, design, and software — is owned by Podvance and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial learning. Podcast content remains owned by its rights holders as described in Section 5.

You retain any content you submit to the Service (such as profile information), and grant us the license needed to operate the Service — to host, store, display, and process it for the purposes described in these Terms and the Privacy Policy.

9. Termination

You may stop using the Service at any time and may delete your account in the app settings or by contacting support@podvance.com.

We may suspend or terminate your access to the Service if you materially violate these Terms, if required by law, or if we discontinue the Service. Where practical, we will give you reasonable notice. Sections that by their nature should survive termination (including Sections 5, 6, 8, 10, 11, and 12) survive.

10. Disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Podvance is a language-learning aid; we do not guarantee any particular learning outcome.

11. Limitation of Liability

To the maximum extent permitted by law, Podvance will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to your use of the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim arose, or, if you have paid nothing, to the minimum amount permitted by law. Nothing in these Terms limits liability that cannot be limited by law.

12. Changes to the Service and These Terms

We may modify the Service over time. We may also update these Terms; when we do, we publish a new version with a new version identifier and effective date, and previous versions remain available in our archive. If the changes are material, we will notify you in the app and ask you to review and accept the new version before continuing to use the Service. If you do not accept the updated Terms, you must stop using the Service.

13. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Podvance regarding the Service.
